The information, features, tools, and services provided through the Medigence Health mobile application, web application, website, and related platforms (collectively, the “Platform”) are intended solely for general health tracking, monitoring, and facilitation of communication between users and their chosen healthcare providers.
1. No Medical Advice
Medigence Health Private Limited does not provide medical advice, diagnosis, treatment, or prescriptions.
- All health data visualizations, graphs, trends, summaries, alerts, and insights displayed on the Platform are for informational and monitoring purposes only.
- Such information must not be construed as medical advice and must not be relied upon as a substitute for professional medical judgment, diagnosis, or treatment.
- Users are strongly advised to consult a qualified Registered Medical Practitioner (RMP) for any medical concerns, decisions, or emergencies.
2. No Emergency Use
The Platform is not designed or intended for medical emergencies.
- Medigence Health does not monitor, detect, escalate, or respond to emergency situations.
- In case of a medical emergency, users must immediately:
- Contact local emergency services, or
- Visit the nearest hospital or emergency care facility.
Reliance on the Platform for emergency care is strictly at the user’s own risk.
3. Independent Doctor–Patient Relationship
Any consultation facilitated through the Platform establishes a direct and independent doctor–patient relationship solely between the user and the doctor selected by the user.
- Doctors operate in their independent professional capacity.
- Medigence Health:
- Does not employ doctors
- Does not control or influence clinical decisions
- Does not supervise, verify, or guarantee medical advice, diagnosis, prescriptions, or treatment
- Medigence Health bears no liability for any medical outcomes resulting from such consultations.
- Medigence Health verifies basic documents submitted by doctors during onboarding. However, patients are advised to independently verify the doctor’s credentials before availing medical services. Medigence Health is not responsible for the medical advice or information provided by doctors on the platform.
4. Technology Platform & Intermediary Role
Medigence Health acts solely as a technology intermediary, as defined under Section 2(1)(w) of the Information Technology Act, 2000.
- The Platform merely facilitates the transmission and storage of user-generated information.
- Medigence Health does not initiate transmissions, select recipients, or modify medical content.
- The Company is entitled to Safe Harbour protection under Section 79 of the IT Act, 2000.
5. Data Accuracy & User Responsibility
Users are solely responsible for:
- The accuracy, completeness, and truthfulness of the health data entered
- Ensuring devices used for tracking (glucometers, wearables, etc.) are properly calibrated
Medigence Health does not verify the accuracy of user-entered or device-generated data and shall not be liable for decisions made based on incorrect or incomplete information.
6. Limitation of Liability
To the maximum extent permitted by law:
- Medigence Health shall not be liable for:
- Medical outcomes
- Clinical decisions
- Data inaccuracies
- Service interruptions
- Indirect, incidental, or consequential damages
- Use of the Platform is entirely at the user’s own risk.
7. Regulatory & Legal Compliance
The Platform is designed to align with applicable Indian laws and regulatory frameworks, including:
- Digital Personal Data Protection Act, 2023
- Information Technology Act, 2000
- CERT-In cybersecurity directives
- Telemedicine Practice Guidelines (India)
However, compliance does not imply clinical endorsement, medical certification, or government approval of medical outcomes.
8. Acceptance of Disclaimer
By accessing or using the Platform, you:
- Acknowledge that you have read and understood this Disclaimer
- Agree that Medigence Health is not responsible for medical decisions or outcomes
- Agree to use the Platform in conjunction with professional medical advice
