These Terms & Conditions (“Terms”) govern your access to and use of the Medigence Health mobile applications, web applications, website, and related services (collectively, the “Platform”), operated by Medigence Health Private Limited (“Medigence Health,” “Company,” “we,” “us,” or “our”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and the accompanying Privacy Policy, which forms an integral part of these Terms.
If you do not agree, you must not access or use the Platform.
2.1 Technology Facilitation Only
Medigence Health is a technology-enabled health tracking and communication platform.

The Platform is not intended for medical emergencies.

Medigence Health cannot be relied upon to monitor, detect, escalate, or respond to emergency situations.
2.3 Intermediary Status
Medigence Health operates as an “Intermediary” as defined under Section 2(1)(w) of the Information Technology Act, 2000. Our role is strictly limited to providing a platform for the transmission of information. We do not initiate the transmission, select the receiver, or modify the information contained in the transmission. We are entitled to “Safe Harbor” protection under Section 79 of the IT Act.
3.1 Prescribing Limitations
You acknowledge that Registered Medical Practitioners (RMPs) on this Platform are prohibited from prescribing medications listed in “Schedule X” or other narcotic/psychotropic substances via telemedicine. 3.2 Doctor Identification: The Platform shall ensure that the RMP’s Name, Qualification, and State Medical Council Registration Number are visible to you during the consultation.
3.2 Doctor Verification, User Responsibility & Liability Disclaimer
Medigence Health undertakes a limited verification process during the onboarding of doctors on the Platform, which may include the collection and review of identity documents, professional credentials, and medical registration details as submitted by the doctor. Such verification is conducted solely for platform onboarding purposes and does not constitute a representation, warranty, endorsement, certification, or guarantee of the doctor’s qualifications, competence, conduct, or medical advice.
You expressly acknowledge and agree that the ultimate responsibility to independently verify the credentials, qualifications, experience, and suitability of any doctor rests solely with you. Medigence Health does not assure the accuracy, completeness, or authenticity of any information provided by doctors on the Platform.
Any medical consultation, advice, diagnosis, treatment, prescription, or information provided by a doctor through the Platform is rendered strictly in the doctor’s independent professional capacity. In the event of any misinformation, misrepresentation, negligence, misconduct, or dispute arising out of medical services or advice provided by a doctor, such dispute shall be exclusively between the doctor and the patient.
To the maximum extent permitted under applicable law, Medigence Health shall not be liable for any claims, losses, damages, injuries, or legal consequences arising from or related to the acts, omissions, or representations of any doctor. Medigence Health shall not be a party to any legal proceedings between a doctor and a patient.
3.1 Account Responsibility
You are solely responsible for maintaining the confidentiality of your account credentials (password and login information) and for all activities that occur under your account. You agree to immediately notify Medigence Health of any unauthorised use of your account.
3.2 Confidentiality of Consultation
You acknowledge that the content of your consultations with the RMP may be recorded and stored on Medigence Health’s secure servers in accordance with the Privacy Policy and Telemedicine Practice Guidelines.
3.3 Prohibited Conduct
You agree not to use the Service for any illegal or unauthorised purpose, including:

In accordance with the Digital Personal Data Protection Act, 2023, you agree to: (a) not suppress any material information; (b) not furnish any false information; (c) not impersonate another person; and (d) not register false or frivolous grievances. Breach of these duties may attract penalties under applicable law. 4.2 Right to Nominate: You have the right to nominate any other individual who shall, in the event of your death or incapacity, exercise your rights as a Data Principal.

11.1 Technical Compliance
To ensure the integrity of audit logs and digital evidence as per CERT-In Directives, the Platform synchronizes its ICT system clocks with the Network Time Protocol (NTP) of the National Informatics Centre (NIC). 11.2 Incident Reporting: We are legally mandated to report any “Cyber Security Incident” to CERT-In within 6 hours of notice. You agree to cooperate with any investigation resulting from a security breach.
We reserve the right to suspend or terminate access to the Platform if:

To the maximum extent permitted by law:
You agree to indemnify and hold harmless Medigence Health, its directors, officers, employees, and affiliates from any claims, damages, losses, or expenses arising from:

Continued use of the Platform after notification constitutes acceptance of revised Terms.

We will acknowledge your grievance within 48 hours and aim to resolve it within 30 days. 17.2 Escalation: If you are unsatisfied with the resolution, you have the right to approach the Data Protection Board of India (DPBI) as per the DPDP Act 2023.
